The new provisions of Article L. 145-9 of the Commercial Code resulting from the Law of 4 August 2008, concerning the date for which notice to quit must be given where the contractual expiry date does not fall at the end of a calendar quarter, apply where the lease has been tacitly extended, but not to a notice to quit given at the end of a three-year period.
